Horizontal gaze nystagmus, often called HGN, is an eye-movement test that may appear in a DWI investigation. In State v. Godwin, 369 N.C. 604 (2017), the North Carolina Supreme Court examined how an officer was qualified to testify about it.
The case arose from a Charlotte-Mecklenburg traffic stop and a DWI prosecution. The court rejected the proposition that expert qualification always requires an express announcement using a particular form of words. On the record before it, the trial judge had implicitly recognized the officer as an expert.
What the ruling actually addressed
The court examined the officer’s training and experience, the testimony concerning the test, and the trial judge’s rulings. It explained that the 2011 amendment to Rule 702 did not erase every earlier principle concerning how a court recognizes an expert. The relevant portion of the Court of Appeals’ decision was reversed.
Godwin does not make all HGN testimony automatically admissible. The qualification, reliability, and application questions remain important. The scope of the testimony matters too: an observation about impairment is not an unrestricted license to claim an exact alcohol concentration from eye movement.

Three parts of a useful review
Counsel should distinguish a challenge to the officer’s qualifications from a challenge to how the test was conducted or how far the opinion extends. A general objection may not preserve every distinct issue. The transcript, relevant records, and video are more useful than a shorthand description that the driver ‘failed the eye test.’
